A. Official Contest Rules
Contest: Foskey Heating & Air’s Lowcountry Talent Contest
Sponsor: Foskey Heating & Air, LLC (“Foskey” or “Sponsor”)
Sponsor address: 6983 N. Okatie Highway Suite C, Ridgeland, SC 29936
Contest contact: info@foskeyheatingandair.com

Rules version/date: Website Final, 10/27/2026
1. No Purchase; Contest of Skill
No purchase, payment, donation, or service engagement is required to enter or win. A purchase or business relationship with Foskey will not improve an entrant’s score. Selection is based only on the published skill-based criteria below, not a drawing, chance, public voting, social-media engagement, or popularity.
2. Eligibility
The Contest is open only to individual students who are at least fourteen (14) years old when they submit their entry and are then enrolled in a high school or college program, or a qualifying homeschool program, with the following Beaufort or Jasper County, South Carolina connection:
- The student attends school in Beaufort or Jasper County; or
- The student takes online classes from a home in Beaufort or Jasper County, even if the school is located elsewhere; or
- The student is homeschooled in Beaufort or Jasper County.
All colleges are included. Online, part-time, and dual-enrollment students may enter. Enrollment and the applicable county connection must exist when entering. Entrants must provide reasonable proof if selected for verification; a particular school does not sponsor or endorse this Contest merely because its students qualify.
Entrants ages fourteen (14) through seventeen (17) must complete the separate parent/legal guardian consent process before their entry becomes eligible. A parent/guardian must also participate in winner verification and signing, as applicable. Individuals under fourteen (14) are ineligible, even with parent/guardian consent. Turning fourteen after submitting an entry does not make that entry eligible.
Employees, owners, managers, Contest judges, and their immediate family and household members are ineligible. For this purpose, immediate family means spouses, parents, children, and siblings, including step and adoptive relationships.
Only individual entries are allowed. No joint/team entries or outside co-writers are permitted. Each entrant must be the sole human author of the entry’s lyrics and music. Non-writing singers, musicians, and recording producers are prohibited.
3. Contest Dates and Entry Procedure
Entries open at January 1, 2027 and close at March 31, 2027 at 4:30 P.M., Eastern. Entries must be received through https://foskeyheatingandair.com/contest/enter/ by the deadline. One entry per student is permitted. Entry revisions before the deadline are not permitted.
Each entry must include:
- An audio-only jingle of no more than 60 seconds;
- A paragraph of no more than 250 words answering: What does it mean to grow up in the Lowcountry and how has that shaped you as a person?
- The completed entry form, including any AI and third-party assistance disclosures;
- Acceptance of these Rules; and
- Completed parent/guardian consent for entrants ages fourteen (14) through seventeen (17).
The paragraph is evaluated only if the fallback process in Section A(6) is triggered. It is not part of ordinary jingle scoring. Requiring the paragraph at entry ensures that all eligible entrants can be considered if the fallback is triggered.
Audio must be supplied as an upload MP3 or MP4 file, with a maximum file size of 25MB maximum, by clicking on the box that says “Choose File” and selecting the correct file from your device and selecting Open and Submit written lyrics through the online submission form in the proper format(s) listed. Click the Choose File button, browse the files on your device, and click Open the attachment. The attachment will be stored in the submission with all entrants’ information. No video entries are accepted.
Sponsor may reject incomplete, late, inaudible, technically unusable, ineligible, infringing, or otherwise noncompliant entries. Sponsor will apply the same published requirements to all entrants. Technical issues should be reported to the Contest contact; reporting an issue does not itself extend the deadline.
4. Originality, AI, and Rights Disclosure
AI assistance is allowed, but an entry may not be entirely AI-generated. It must contain human-created lyrics or music, created by the entrant. Entrants must identify the human-created portions and disclose the AI tools used and how they were used. Permission to use AI does not establish copyright ownership in AI-generated material.
The entrant must be the sole human author of the lyrics and music and must have sufficient rights in the submitted recording and any other material to permit the Contest uses. No outside co-writers are allowed. The paragraph must be the entrant’s own writing; any assistance must be disclosed at entry.
Entrants must disclose any samples, loops, stock audio, existing music, outside performers, recording producers, and third-party material. Third-party material is prohibited. Disclosure does not by itself authorize use. Entrants must not submit material that violates another person’s copyright, trademark, privacy, publicity, or contractual rights.
A selected jingle must pass rights clearance review before it is confirmed or used commercially. If rights cannot be cleared, the entry will be disqualified and the published scoring and fallback process reapplied to the remaining eligible entries.
5. Jingle Judging
The judges will be the Owners of Foskey Heating & Air, Mike and Christine Foskey. Every eligible jingle will be evaluated under the following criteria. Judges will score each criterion from 0 to 10, with 0 the lowest and 10 the highest. The weighted total is calculated on a 100-point scale. If there are multiple judges, their weighted totals will be averaged.
| Jingle criterion | Weight | Scoring guidance |
|---|---|---|
| Memorability and suitability | 30% | Whether the jingle is memorable and suitable for Foskey’s brand and services under the published content requirements |
| Clarity and Communication | 30% | Whether the words and business message are understandable and effectively communicated |
| Musical Quality | 25% | Melody, rhythm, singability, and overall musical effectiveness |
| Creativity and originality | 15% | Distinctiveness and originality of the entrant’s human-created contribution |
| Total | 100% |
The minimum qualifying jingle score is 80 points out of 100. If at least one eligible jingle reaches that minimum, the highest-scoring qualifying jingle is the prospective winner, subject to tie-breaking and verification.
Jingle ties will be resolved as follows: An assessment, in the form of a quiz, based solely on information listed on Foskey Heating & Air’s website, about their Story, Services, Service Area, and Blog/News. No prize splitting or additional prize is authorized unless expressly stated in the completed Rules before launch.
6. Paragraph Fallback
If no eligible jingle reaches the published minimum qualifying score, the judges will evaluate the paragraphs submitted with eligible entries. A low jingle score alone does not disqualify an otherwise compliant entry from paragraph judging.
The judges will score paragraphs using these published criteria:
| Paragraph criterion | Weight | Scoring guidance |
|---|---|---|
| Memorability and Relevance | 30% | Whether the paragraph makes a lasting impression, meaningfully addresses the prompt, and demonstrates a genuine connection to the South Carolina Lowcountry. |
| Clarity and Communication | 30% | Whether the entrant clearly communicates their thoughts, personal experiences, and how growing up in the Lowcountry has influenced who they are. |
| Writing Quality and Effectiveness | 25% | Organization, sentence structure, word choice, readability, and overall effectiveness in communicating a compelling personal reflection. |
| Creativity and Originality | 15% | Distinctiveness of the entrant’s perspective, authentic personal expression, and originality of the entrant’s human-created contribution. |
| Total | 100% |
Winner publicity consent addresses photographs and similar materials, not jingle rights.
7. Prize and Payment
One $1,000 contest prize will be awarded, either through jingle selection or the paragraph fallback, provided an eligible winner completes verification. The prize is payable to the winner during the second quarter of 2027, no later than June 30, 2027. A public presentation ceremony is planned; its location and date will depend on the winner’s school and coordination with the relevant school or venue.
Payment method: check. Payment will occur separately. If the ceremony cannot occur or the winner cannot attend, Foskey Heating & Air will leave a check for the winner at the front office of their School or program in a sealed envelope. For a minor, the payment delivery process is payable to the parent/guardian.
The winner is responsible for applicable taxes. Sponsor may request properly completed tax documentation and make reports required by law. Tax information will be requested securely during verification, not through the public entry form. No educational spending restriction applies.
8. Winner Verification
Sponsor will contact the prospective winner using the entry information on or about May 15, 2027. Selection is provisional until eligibility and rights verification are complete and the required winner documents are signed. The prospective winner must respond to follow-ups, provide reasonably requested verification information, and sign the applicable final winner documents within thirty (30) calendar days after notice.
By entering, each entrant agrees to complete these requirements if selected as a condition of receiving the prize. Verification includes enrollment/county eligibility, age and guardian status, originality and rights disclosures, prize acceptance, and applicable winner documents. The required documents are Winner Eligibility and Prize Acceptance, either the Winning Jingle Copyright Assignment or the Paragraph Fallback Winner Publication Permission depending on the award path, and the Winner Publicity Consent. The completed forms are available for review before entering at https://foskeyheatingandair.com/contest/winner-forms/. No materially broader rights grant or new award condition will be imposed after entry.
Sponsor will provide the applicable winner documents together in one electronic signature packet where practicable. Entrants under 18 must have their parent/legal guardian participate in verification and signing as applicable, and any additional legally necessary authorization must be completed. Entry acceptance and parent/guardian entry consent do not themselves transfer copyright or grant winner-publicity rights.
If a prospective winner is ineligible, does not respond within thirty (30) calendar days, refuses a disclosed award condition, or cannot clear required rights, Sponsor will disqualify that entry, reevaluate the remaining eligible entries under the same published process, and contact the next prospective winner. If no remaining jingle qualifies, the paragraph fallback applies. If no eligible entrant can be confirmed under either path, no prize will be awarded. Decisions will be based on these Rules, not unpublished preferences.
9. Entry Ownership and Winner Rights
Entrants retain their rights until any separate winner agreement is signed. Submission does not transfer copyright to Foskey. Each entrant gives Sponsor a nonexclusive, royalty-free permission to receive, store, copy internally, and provide the entry to judges and advisers solely to administer, judge, verify, and document the Contest. This permission does not authorize public posting or advertising use of a non-winning entry. Records may be retained under the disclosed retention policy and applicable legal obligations.
A confirmed jingle winner will assign the transferable rights the winner owns in the selected lyrics, music, and recording, subject to disclosed and approved limitations. The $1,000 prize is the compensation for that transfer. Foskey may edit and re-record the selected jingle and use it in online and television advertising and other uses expressly identified in the assignment, without additional royalties, subject to rights that cannot lawfully be waived.
A confirmed paragraph winner will grant nonexclusive permission to publish the paragraph in all Foskey Heating & Air ads, publications, posts, blogs, and other venues, for an unlimited term, in the Lowcountry, with unlimited edits. No paragraph copyright ownership or jingle rights transfer occurs. Only the confirmed winner’s work will be publicly published by Foskey under this Contest.
10. Personal Information and Publicity
Entry information will be used only as reasonably necessary to administer the Contest, verify eligibility, communicate with entrants and their parents or guardians, clear rights in the selected work, pay the prize, maintain Contest records, and comply with legal requirements. It will not be used for unrelated marketing without separate consent. Sponsor may provide this information to service providers and professional advisers as reasonably necessary for these purposes, or as required by law. These administrative disclosures are separate from the limited public disclosures described below.
Sponsor will not publicly disclose non-winning entrants’ identifying information or publish their entries or paragraphs under the Contest entry permission.
Subject to the separate signed Winner Publicity Consent, Sponsor may publicly share only the confirmed winner’s name, school name, the Beaufort or Jasper County the winner represents, and a photograph of Sponsor presenting the winner with the prize check, solely to announce and publicize the Contest and its winner. This permission does not authorize interviews, video recordings, or other photographs or personal information. For a winner under 18, Sponsor will obtain the winner’s and parent or legal guardian’s signatures on the separate Winner Publicity Consent before making these public disclosures.
Publication and use of the winning paragraph or jingle are governed by the applicable separate Paragraph Publication Permission or Jingle Copyright Assignment. This section neither expands those rights nor limits advertising uses expressly granted in the Jingle Copyright Assignment. The check-presentation photograph will not display bank account or routing numbers, signatures on the check, or other financial information beyond the prize amount and winner’s name.
Sponsor will not publicly disclose entrants’ contact information, home addresses, dates of birth, student identification numbers, private school records, tax information, or eligibility-verification documents. Sponsor will collect and retain only information reasonably necessary for the purposes stated above, limit access to those who need it for those purposes, and maintain and dispose of it under the Contest’s approved privacy and record-retention procedures.
11. Administration and Changes
Sponsor may suspend or cancel the Contest if fraud, a significant technical failure, legal restrictions, or circumstances beyond its reasonable control prevent fair administration. It will post notice and explain the reason and treatment of timely entries. Sponsor will not retroactively change the judging criteria, qualifying threshold, or prize amount after entries open. Material pre-launch changes must be reflected consistently in the Rules and advertising. Any permitted post-launch administrative change must preserve fair treatment and be communicated to affected entrants.
South Carolina law governs, subject to applicable federal law. These Rules and the applicable signed winner agreements govern the Contest and awarded rights. No provision purports to waive rights that cannot lawfully be waived. Questions or concerns should be directed to the Contest contact. Sponsor will retain eligibility decisions and judging records for at least two years after the announcement, subject to the approved privacy and retention procedures.
